Please read these Terms of Use ("Terms") carefully before using our applications (the "Apps") operated by Online Ocigrup SL ("we," "us," "our"). Your access to and use of the Apps is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Apps.

By accessing or using the Apps, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Apps.

Online Ocigrup SL develops mobile applications & games ("Our Products"). Our Apple Applications may be downloaded from the App Store, which is operated and owned by Apple Inc. and other companies within its group ("Apple"). Our Android Applications may be downloaded from Google Play, which is owned and operated by Google Inc. and other companies within its group ("Google"). We develop Our Products for informational purposes only. By agreeing to these Terms and Conditions you confirm that you are solely responsible for your state of health.

Our Apps provide various features that may include the generation of images and other content ("Generated Content"). You agree to use the Apps only for lawful purposes and in accordance with these Terms.

You are solely responsible for any content you generate using the Apps and for your use of such Generated Content. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Generated Content in the manner contemplated by the Apps and these Terms.

The source codes, texts, graphics, logos, icons, images, data compilations and information ("Content") contained in Our Products and Services are Intellectual Property of Ocigrup SL (or belongs to it) and are protected by copyright laws. We own and retain all rights in the Ocigrup SL Content and Services.

For Generated Content, the following applies:

• Generated images may inadvertently contain elements that are subject to third-party copyright or other intellectual property rights.
• Online Ocigrup SL is not responsible for verifying the copyright status of any Generated Content.
• You are solely responsible for ensuring that your use of any Generated Content complies with all applicable laws, including copyright laws. This includes obtaining any necessary permissions or licenses for the use of such content.
• Online Ocigrup SL shall not be liable for any copyright infringement or any other claims arising from your creation or use of Generated Content.

The Apps may use Firebase Authentication for anonymous login. No personal data is required to use the Apps.

The Apps display advertisements through AdMob and mediation ad networks. Your interaction with any advertisements is subject to the terms and policies of the respective ad providers.

By using Our Products, you hereby warrant that: (i) all information contained in any submission by you is either owned by you or rights have been granted to you permitting you to disseminate the information as set forth in these Terms; and (ii) the information contained in any submissions by you does not infringe on the intellectual property rights of others, including but not limited to, copyright, trademark, patent, or trade secret rights. You accept full responsibility, assume all risk, and waive and/or release Us from any direct or indirect loss, injury, claim or damage arising from your use of Our Products, whether or not such use was appropriately supervised and regardless of whether you were negligent in such use.

You agree not to use the Apps to:

• Generate or disseminate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
• Transmit any worms or viruses or any code of a destructive nature.

Ocigrup SL Apps may offer Premium Membership subscriptions that grant you access to additional features like premium content and Ads removal. Ocigrup SL offers monthly and annual subscription options. Payment will be charged to your iTunes Account or Google Play Account at confirmation of purchase.

Paid Subscriptions automatically renew until cancelled in the Manage Subscriptions section of your account settings. We will notify you if the price of a Paid Subscription increases and, if required, seek your consent to continue. You will be charged no more than 24 hours prior to the start of the latest Paid Subscription period. If you decide to unsubscribe from a Paid Subscription before we start charging your payment method, cancel the subscription before the free trial ends.

Our Service is provided "AS IS" and "AS AVAILABLE", without express or implied warranty or condition of any kind. You use the Ocigrup SL Service at your own risk. To the fullest extent permitted by applicable law, Ocigrup SL and all owners of the content make no representations and disclaim any warranties or conditions of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement.

In no event shall Ocigrup SL be liable for any loss or damages (including without limitation of any direct, indirect, punitive, special, incidental or consequential loss or damage):

• Access to the Service or inability to access to the Service;
• Any third party's conduct, content, information or data;
• Personal injury or property damage, of any nature whatsoever, resulting from your access to and/or use of (or your inability to access and use) the Ocigrup SL Services, including, without limitation, making private content public or any damage caused to your computer or software or information stored thereon;
• Any unauthorized access to or use of Ocigrup SL Services and/or any and all personal, private, and/or other information stored therein.
• Any damages for loss of data or profit, or due to business interruption arising out of the use or inability to use the Apps or Generated Content, even if Online Ocigrup SL has been notified of the possibility of such damage.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms within the Apps. Your continued use of the Apps after any such changes constitutes your acceptance of the new Terms.

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.
